Judge Denies State's Attempt to Call Off Butter Lawsuit

A lawsuit challenging a six-decade old law that requires all butter sold in Wisconsin be tested and graded by state-approved inspectors will be heard, despite the state's attempt to put the issue to rest. The Wisconsin Department of Agriculture asked an Ozaukee County judge to dismiss part of the case, claiming the process helps consumers know more about the products they buy. But the Hon. Paul Malloy denied the motion.

The suit, filed by the Irish-based Kerrygold Company, attempts to allow their products be sold in the state.

Another case was filed by the Ohio-based Minerva Dairy, which feels that Wisconsin's ban on the sale of ungraded butter is 'unconstitutional' because it protects large Wisconsin-based dairies.

As part of the current policy, anyone convicted of selling unlabeled or ungraded butter could face fines of up to $1,000 and spend six months in jail.
