COVID-Infected Food Plant Worker Suing ConAgra Foods



An employee of ConAgra Foods Packaged Foods in Darien is taking the company to court after he contracted the COVID-19 virus while on the job and then spread it to his wife who died from the disease. Rigoberto Ruiz of Beloit claims the facility failed to enforce safety measures, such as requiring workers to work face masks.

The Milwaukee Journal-Sentinel reports that Ruiz filed the complaint in Walworth County Circuit Court earlier this year, but ConAgra is asking the federal Wisconsin Eastern District Court to hear the case instead.

The suit claims the company was negligent because it failed to adopt and enforce policies required by the CDC and indicated by generally understood medical advice to prevent transmission of COVID-19.

Ruiz's wife, Martha Amador De Ruiz, died from complications of coronavirus on May 5, 2020.

A spokesman for ConAgra says the company did take preventive measures to keep its workforce safe.
